Scaffold Law Did Not Apply to Accident Where Employee Disregarded Instruction to Replace manhole Cover

Thomson Reuters’ Legal Solution Blog shared a recent ruling against a Scaffold Law claim in a case where an employee disregarded specific instructions to replace a manhole cover over a manhole which he later fell into.

“Scaffold Law did not apply to accident involving fall by contractor’s employee into uncovered manhole while performing asbestos removal work below city streets; employee was provided with perfect safety device, namely, manhole cover, which was nearby and readily available and he disregarded his supervisor’s explicit instruction given that day to replace cover before dismantling enclosure.”
