Albany Times Union: McDonald backs Scaffold Law reform legislation

“Assemblyman John McDonald has introduced what his office describes as ‘a concise and comprehensive bill aimed at modernizing the liability rules’ under the state’s perennially controversial Labor Law 240, otherwise known as Scaffold Law.

Scaffold Law, which has been interpreted as placing ‘absolute liability’ on employers for gravity-related workplace injuries, is strongly supported by labor unions and but opposed by business groups that claim it needlessly drives up construction costs, and the municipal governments, school districts and others who pay those building costs. Opponents would like to see New York move to a ‘comparative negligence’ standard that would make workers proportionately responsible when their own actions contribute to an accident.”
